US steps in to nip in bud Modi legal wrangle, says he enjoys immunity

  • NEW YORK: Prime Minister Narendra Modi will have total immunity from legal proceedings in the US that have been initiated by human rights activists, the Obama administration said on Friday even as the Indian leader arrived in New York to a purported US court order pertaining to the 2002 Gujarat riots.

    Radical Sikh activists who have been carrying out a legal campaign in US to shame the Indian government for perceived human rights excesses attempted to embarrass Modi ahead of his arrival in New York by initiating legal action, resulting in a court order seeking his response to the 2002 communal riots in Gujarat. But the Obama administration stepped in to assure the visiting leader that he's safe from any legal wrangle even as he landed in New York.

    Senior Obama administration officials previewing the visit said in a teleconference that as a visiting head of government, Modi enjoyed complete immunity for the duration of the visit not only from court proceedings, but also from being personally served or handed court summons. "While we cannot comment specifically on this lawsuit, I can tell you that as a general legal principle, sitting heads of government enjoy immunity from suits in American courts," one official said.

    "Sitting heads of government also enjoy personal inviolability while in the United States, which means they cannot be personally handed or delivered papers or summons to begin the process of this," the official said, adding that, "as a matter of treaty, heads of delegation to the UN General Assembly enjoy immunity while in New York to attend the UN event."

    Although touted by an excitable media as the court issuing "summons" to the Prime Minister, the order by a district court in New York only enjoins the Indian Prime Minister to respond within 21 days after he is served notice, and in no way affects his US programme or his visit. Indian government sources say the action, which they suspect is supported by "forces inimical to India," is only aimed at embarrassing the Prime Minister on his first visit to the US in 14 years.

    "Steps being taken 2 address frivolous & malicious attempts 2 distract attention from the visit of @PMOIndia to US," Syed Akbaruddin, spokesman of India's external affairs minister tweeted as soon as the Modi touched down at JFK airport.

Stop prescribing antibiotics for fever and cold, Indian Medical Association will tell doctors

  • NEW DELHI: Faced with the scary prospect of losing lives to simple infections in the future, India is finally waking up to the dangers of reckless antibiotic use. The Indian Medical Association, a pan-India voluntary organization of doctors, will on Sunday launch a nationwide awareness programme on overuse of these live-savers, a practice that has led to emergence of drug-resistant organisms. 

    IMA will also ask fellow practitioners to avoid unnecessary prescriptions such as recommending antibiotics for patients with fever and cold which are generally caused by viral infections. 

    "In the past two decades, almost no new antibiotic has been discovered while bacteria have learnt to overcome the existing ones. If we don't conserve our antibiotics, a day will come when simple infections will become life threatening," said Dr Narender Saini, the secretary general of IMA. 

    Saini said Sunday onwards IMA plans to hold public lectures and 'training of trainers' aimed to press for rational use of drugs among the medical fraternity. IMA, he added, has 2.5 lakh member doctors registered with its 1,700 branches across the country and all of them will be part of the initiative.

    Several researches, including those conducted by WHO in India, have revealed that over-the-counter sale and purchase of antibiotics is rampant in the country. There is also lack of knowledge about the exact use of each antibiotic among physicians.

Nawaz Sharif raises J&K issue at UNGA, blames India for ‘another missed opportunity’

  • UNITED NATIONS: Pakistan Prime Minister Nawaz Sharif on Friday raked up the Kashmir issue at the UN General Assembly here and blamed India for "another missed opportunity" to address outstanding issues by cancelling the foreign secretary-level talks. 

    Asserting that a "veil" cannot be drawn over the "core" issue of Kashmir, he said Pakistan is ready to work for resolution of this problem through negotiations. 

    "Our support and advocacy of the right to self- determination of the people of Jammu and Kashmir is our historic commitment and a duty, as a party to the Kashmir dispute," he said while addressing the annual UN General Assembly session. 

    Needling India, Sharif said that more than six decades ago, the UN had passed resolutions to hold a plebiscite in Jammu and Kashmir. 

    "The people of Jammu and Kashmir are still waiting for the fulfillment of that promise," he said. 

    "Many generations of Kashmiris have lived their lives under occupation, accompanied by violence and abuse of their fundamental rights. Kashmiri women, in particular, have undergone immense suffering and humiliation," he said. 

    For decades, attempts have been made, both under UN auspices and bilaterally in the spirit of the Lahore Declaration, to resolve this dispute, he said. 

    "The core issue of Jammu and Kashmir has to be resolved. This is the responsibility of the international community. We cannot draw a veil on the issue of Kashmir, until it is addressed in accordance with the wishes of the people of Jammu and Kashmir," Sharif told the gathering. 

    India had called off the foreign secretary-level talks in August after Pakistan high commissioner Abdul Basit met Kashmiri Hurriyat leaders in New Delhi, ignoring India's warning not to meet the separatist leaders.

  • Pakistan is likely working to create tactical nuclear weapons, which are smaller warheads built for use on battlefields rather than cities or infrastructure. These weapons are diminutive enough to be launched from warships or submarines, which makes them easier to use on short notice than traditional nuclear weapons. 

    Developing tactical nuclear weapons calls for miniaturization of current weaponry (the "Davy Crockett," developed by the US in the '50s, was designed to launch from a simple tripod). But as The Washington Post reports, analysts are divided on whether Pakistan will be able to make warheads tiny enough for sea-launching. 

    There's less uncertainty about the military advantage gained with such weapons. A warhead-toting navy would allow Pakistan to stay nuclear-capable regardless of what happens to its homeland, where its nuclear infrastructure is spread out. 

Uddhav calls Raj, duo sets up hotline for Sena-MNS talks

  • MUMBAI: A day after Maharashtra's two major political alliances came apart, the political firmament was rocked by talk of the estranged Thackeray cousins cosying up to each other. Shiv Sena chief Uddhav Thackeray reportedly called up MNS boss Raj Thackeray on Wednesday to inquire after his health. The two have since appointed representatives for their parties to "talk to each other".

    Sources said the Sena may want MNS as an ally in key civic bodies like Mumbai, Thane, Kalyan-Dombivli if BJP pulls out from these bodies.

    The development came as just-separated alliance partners attacked each other, indicating a bitter five-cornered fight for the October 15 polls.

    Shiv Sena mouthpiece Saamna hit out at BJP, saying those who terminated the alliance were "enemies of Maharashtra". It described them as "crows of pitru paksha".

    BJP leader Rajiv Pratap Rudy said the comments were "uncalled for" and said Matoshree could not have expected BJP to "betray" smaller partners in the 'maha yuti'.

HC says taken for 'jolly ride', asks O P Chautala to surrender

  • NEW DELHI: Taking a dim view of former Haryana chief minister O P Chautala's poll campaigning while out on bail on health grounds, the Delhi high court on Friday directed him to surrender by October 17. Chautala has been sentenced to 10 years in jail in a teachers' recruitment scam case.

    Taking note of the CBI's submission that Chautala attended a rally in Haryana's Jind town on Thursday, Justice Siddharth Mridul warned Chautala a medical board would be set up to examine his health and submit a report. At this, Chautala's lawyer gave the assurance the INLD chief would surrender before October 17. The undertaking came just as the HC was on the verge of roping in AIIMS doctors for their views on the necessity of keeping Chautala hospitalised.
