  • Improving Collegium System: Public Notice Invites Suggestions
    NEW DELHI:  The government today issued a public notice inviting suggestions from the common man on ways to improve the collegium system to appoint judges to the Supreme Court and the high courts.

    The apex court had yesterday asked Attorney General Mukul Rohtagi to issue a public notice inviting representations and suggestions from all quarters of the public and web-host on the website of the Law Ministry by 1700 hours of November 13.

    The bench which struck down a new law to replace the collegium system last month is now hearing ways to improve the collegium system. The over 20-year-old collegium system has been criticised for lack of transparency.

    The top court also accepted the view of Bar Council of India that the apex lawyers' body be allowed to hold a meeting with all state bar associations and advocates' bodies from across the nation for compilation of various suggestions.

    The notice issued by the Department of Justice in the Law Ministry said the suggestions can be made in four categories -- transparency, collegium secretariat, eligibility criteria and complaints.

    The Department of Justice has given a link on its website doj.gov.in on how to make suggestions.

    "...he (Attorney General) may web-host the compilation and issue a public notice. Likewise, all those who desire to make suggestions may do so directly, on the website of the Department of Justice, Ministry of Law and Justice, New Delhi," the bench, comprising Justices JS Khehar, J Chelameswar, MB Lokur, Kurian Joseph and AK Goel, said while posting the matter for hearing on November 18 and 19.

        • Military Veterans to Return Medals Over Delay in One Rank One PensionNEW DELHI:  Armed forces veterans, upset at the delay in the one rank one pension or OROP scheme being notified, have decided to return the medals they have been honoured with in the country's service.

          The veterans said the decorated soldiers among them would hand over their medals on Tuesday and Wednesday next week at the arrival halls of the Delhi airport and at the offices of district collectors in other parts of the country.

          Ex-servicemen abroad will return their medals at embassies, they said.

          The government has promised the veterans that a notification to effect OROP will be issued as soon as the Bihar assembly election is over, pleading that a model code of conduct prohibits it from notifying new schemes during elections. Votes will be counted on Sunday, November 8.

          The threat to return medals is aimed at pressuring the government to notify OROP on Monday, November 9. It is already under attack from a number of writers, filmmakers and others who have returned prestigious awards to protest against what they call "rising intolerance."

          The government had, after negotiations that went on for months, announced on September 5 that it would implement OROP, which ensures that armed personnel of the same rank will draw the same pension regardless of when they retired.

          Defence Minister Manohar Parrikar had earlier said the government was trying to issue the notification before Diwali, which falls on November 11.

          Veterans protesting in New Delhi said last week that they have no faith in Defence Minister Manohar Parrikar's promise. "The minister has changed the goalposts and hence the veterans have no faith in this statement," Major General Satbir Singh (retd), who has led the ex-servicemen's protests, said.

          Some groups of veterans had also said that the provisions that the government has announced on OROP has shortcomings.

        • Maharashtra Postal Circle to Install 75 ATMs by November-End: OfficialMUMBAI:  Maharashtra postal circle aims to install 75 automated teller machines (ATM) by the end of this month, including two more in Mumbai region, a senior official said today.

          Out of 75 ATMs which have been decided to be installed at different locations of the circle, 17 would be installed in Mumbai region, 17 in Aurangabad, 14 in Goa, 16 in Nagpur and 11 in Pune.

          "We have successfully installed 11 ATMs across the circle so far, which are completely functional, and would install two more in Mumbai region by the end of this month," said a senior postal official, adding the two ATMs would be installed at Dadar and Chinchbunder.

          Currently, two ATMs each are functional in Mumbai, Nagpur, Goa, Aurangabad and three in Pune city.

          "The ATM facilities would be launched shortly and the work of processing postal ATM cards is underway, to allow e-account holders to withdraw money from any postal ATM, provided they have enough savings.

          "Customers can use any other Core Banking Solution (CBS) enabled facility to withdraw or deposit money into his/her account. Hence, a post office savings account holder from Mumbai can visit the post office with CBS facility in Pune, Goa, Delhi or Kolkata and use the ATM to withdraw or deposit money," the official added.

          In an effort to provide enhanced and value-added solutions to its customers, India Post had announced to set up 1,000 ATM centres at different post offices across the country as part of its massive IT modernisation project.

          It aimed to provide better customer services through IT-enabling of business processes and support functions.

        Nepal PM Attacks India for Raising Human Rights Abuses at UN Meet
        • Nepal PM KP Sharma Oli Flays Indian Statement in GenevaKATHMANDU:  Nepal Prime Minister KP Sharma Oli today criticised India for raking up human rights abuses in the Himalayan nation at a UN Human Rights Council meet in Geneva.

          India, for the first time, raised the issue of war crimes committed during the decade-long conflict in any international forum and urged Nepal to carry out the transitional justice mechanisms in an effective way.

          Speaking to the media, Mr Oli demanded to know how India could be ignorant that the UN was involved in Nepal's peace process.

          He said India had not made its position public earlier on Nepal's transitional justice mechanisms or their efficacy but raised the issue at an international body.

          The Indian representative said in Geneva that Nepal should "ensure the effective functioning of the Truth and Reconciliation Commission and full implementation of its recommendations, including prosecution of those responsible for violent insurgency".

          This has been widely interpreted in Kathmandu as another example of India's harsh stand vis-a-vis Nepal.

          Without taking any name, Mr Oli said: "Some days back, one of the leaders from our neighbourhood publicly warned that India will show its mettle against Nepal.

          "Now, they are digging out a decade-old-issue," he added.

          The prime minister said Nepal had formed the Truth and Reconciliation Commission and another commission to probe the disappeared people to address war crime issues such as killings, torture and rape.

          "We faced war in the past. Then we realized it was not possible to have war all the time. So we initiated the peace process," said Mr Oli, adding Kathmandu also invited the UN to resolve the armed conflict.

          "The conflicting parties in the past are together today and carrying out democratic and peaceful reforms, whether they are in the government or not," he said.

        • New Chemical Can Be Used in Eye Drops to Reverse Cataracts: StudyNEW YORK:  A team of scientists has identified a new chemical that can be used in eye drops to reverse cataracts which are a leading cause of blindness worldwide.

          The newly identified compound is the first that is soluble enough to potentially form the basis of a practical eye-drop medication for cataracts.

          The team of scientists from University Of California-San Francisco (UCSF), the University of Michigan (U-M), and Washington University in St. Louis (WUSTL) began with 2,450 compounds, eventually zeroing in on 12 that are members of a chemical class known as sterols.

          One of these, known as lanosterol, was shown to reverse cataracts, but because lanosterol has limited solubility the compound had to be injected into the eye for it to exert its effects.

          Using lanosterol and other sterols as a clue, the group assembled and tested 32 additional sterols, and eventually settled on one, which they call "compound 29", as the most likely candidate that would be sufficiently soluble to be used in cataract-dissolving eye drops.

          The team next tested compound 29 in an eye-drop formulation in mice carrying mutations that make them predisposed to cataracts.

          They found that the drops partially restored transparency to mouse lenses affected by cataracts, as measured by a slit-lamp test of the sort used by ophthalmologists to measure cataracts in humans.

          Similar results were seen when compound 29 eye drops were applied in mice that naturally developed age-related cataracts, and also when the compound was applied to human lens tissue affected by cataracts that had been removed during surgery.

          Identified as a "priority eye disease" by the World Health Organisation, cataracts -- caused when the lenses of the eyes lose their transparency -- affect more than 20 million people worldwide.

          The study was published in the Journal Science.

          • Sensex ends 39 points down; Nifty a tad above 7,950Extending the fall for the third consecutive session, the domestic markets ended lower on Friday, ahead of the Bihar election results, which Prime Minister Narendra Modi-led NDA needs to win to improve the parliamentary strength it needs to push through reforms.
            Modi's nationalists and opposition parties were running neck-and-neck in the elections, according to exit polls on Thursday. Official results will be announced on Sunday.
            The S&P BSE Sensex ended the day 38.96 points lower at 26,265.24, while broader CNX Nifty held its crucial support level of 7,950 to settle 1.15 points down at 7,954.30.
            Market breadth remained negative with 18 of the 30 Sensex stocks ending the day in red.
            Dr Reddy's was the worst performer on both the benchmark indices and settled the day over 14 per cent lower after the company received a "warning letter" from US regulators over inadequate quality controls at three manufacturing plants producing drugs for cancer and other diseases.
            Disappointment over some results, including at Tata Steel , also weighed on sentiment, but state-run lenders rallied after State Bank of India recorded a better-than-expected 25 per cent rise in quarterly profit.
            "Markets think it will be hard for the Modi government to win Bihar elections. That, coupled with somewhat in-line results, are weighing," said Aneesh Srivastava, chief investment officer at IDBI Federal Life Insurance Co.
            Shares of Bank of Baroda wiped out entire losses and settled the day 4.95 per cent higher after cracking 10 per cent in the early trade. The company reported 89 per cent fall in net profit for the quarter ended September 30, owing to high provisions.
            Among Asian markets , China's Shanghai Composite ENDED 1.91 per cent higher, Hong Kong's Hang Seng lost 0.80 per cent, while Japan's Nikkei added 0.78 per cent.

            Overnight, US stocks edged lower as investors digested mixed tech and healthcare earnings a day ahead of Friday's US jobs report.

          • SBI beats forecasts with 25% rise in profitState Bank of India, the nation's top lender by assets, reported a better-than-expected 25 per cent increase in quarterly profit on the back of higher interest income and a drop in bad loans, driving its shares up over 4 per cent.
            Net profit rose to Rs 3,879 crore ($589.5 million) for its second quarter ended September 30, from Rs 3,100 crore a year earlier, SBI said in a statement on Friday.
            Analysts on average had expected the lender to report a net profit of Rs 3,639 crore, according to data compiled by Thomson Reuters.

            Gross bad loans as a percentage of total loans dropped to 4.15 per cent from 4.29 per cent in the June quarter. Provisions for bad loans dropped almost 7 per cent.

            FM Arun Jaitley says higher growth best antidote to poverty
            • FM Arun JaitleyMaking a case for stepping up growth momentum, Finance Minister Arun Jaitley said on Friday the country is pushing for higher growth, which is the best antidote to poverty.
              Observing that the global economy is under stress, Jaitley said although India can take some satisfaction from its own high growth, it has potential to grow at a higher pace.
              "We are not satisfied with that because we do believe that our capacity and endeavour is to reach a higher rate. Eventually, it is growth and higher growth that the Indian economy will need. Higher growth is the best antidote to poverty," he said at the Delhi Economics Conclave in New Delhi.
              The government estimates growth to be between 8-8.5 per cent in the current fiscal. In the previous fiscal, the economy grew 7.3 per cent.
              Referring to subsidies, Jaitley said one has to think whether to continue it indefinitely with an unquantified amount going to an unidentified number of people or target it to specific categories of people needing them.
              He said the JAM (Jan Dhan-Aadhar-Mobile) initiative of the government would help target beneficiaries better.
              He said the country has moved from 58 per cent bank connectivity to a near 100 per cent.
              Similarly, there are 92 crore Aadhar numbers with over 90 crore mobile phones.
              Terming rationalisation of subsidies as "unsung reforms", he said the government made use of the drop in oil prices globally.
              "Over the next few years, our intention is to be that various other areas which are today on pilot projects should actually enlarge themselves at a national level so that the national saving is much more," he added.

              Currently, he said, private investment is slow and till such time that the entire cycle of private sector investment picks up, public investment has to take the lead.

              CLSA added consensus has cut India's FY16 earnings estimates by 1 per cent since the beginning of the results season and 3.5 per cent over the past three months to October.

              1) Infosys: The brokerage expects Infosys to return to industry revenue growth by end FY16 and grow ahead of industry in FY17. They believe multiple strategic initiatives (Zero Bench, Zero Distance, ) spearheaded by CEO Vishal Sikka are at various stages of implementation and signs of early success have been reflected in  the first half of fiscal year 2015-16 in terms of strong revenue growth, deal wins, better client mining and efficiency benefits.
              "We expect full benefits to flow in by FY17-18 and that should result in Infosys leading industry growth with margin improvement. The stock is trading attractive at ~17 times of FY17 earnings per share (EPS). We have BUY rating on the scrip with a target price of Rs 1,440," said brokerage.   
              2) HDFC Bank: Analysts at Prabhudas Liladhar believe theprivate lender reported strong quarter as loan growth pick-up was sharply led by strong traction in both retail and wholesale loans. Revenue growth was also broadly in-line though margins compressed by 10 bps sequentially on expected lines.
              "The bank is well placed to continually gain market share on back of its highly competitive base-rate and robust digital platform. HDFCB remains one of the top-picks for us and we maintain 'buy' with a target price of Rs 1,200," said brokerage.









              3) SBI:
               Brokerage believes State Bank of India has shown some early signs of stabilization in asset quality as fresh slippages have trended lower while management sounded optimistic about revival in capex cycle.
              "SBI is well capitalized, has robust other income and has invested significantly in building up its digital offerings which distinguishes it against its other PSU peers," said brokerage.
              "The public sector lender has been focusing on retail segment and has gained market share in highly competitive mortgage business while it remains cautious on mid-corporate and SME segment. We retain 'buy' with a target price of Rs 350 which corresponds to 1.8 times Mar-17 ABV," added brokerage.
              4) Tata Motors: Broking firm Prabhudas Liladhar is positive on Tata Motors and has a 'buy' rating with a price target of Rs 518.
              "We believe that JLR faces a short-term negative outlook due to weakness in China. However, with its strong product portfolio, JLR is in a good position to counter the slowdown there as well as increase its sale in other geographies, thereby resulting in a positive outlook from a medium-to-long-term perspective," said broking firm.
              "In the India business, with M&HCV volumes already on the move, and a recovery expected in LCVs by fourth quarter of FY16, the turnaround in India operations would get completed in FY17," added brokerage.
              5) JK Laxmi Cement: JK Lakshmi cement , the 5th largest cement producer in North India with a ~7% market share in the region with a capacity of 9mtpa, is backed by 1) one of the most efficient operations, 2) entry into the most profitable eastern region with a capacity of 2.7mtpa, and 3) increasing consolidation in Gujarat (~40% of its total volumes), said brokerage.
              PL ranked JK Laxmi as one of their top pick in the sector with a target price of Rs 450 at EV/T of US$100 FY17E capacity of 12m tonnes.
              Angel Broking
              1) Ashok Leyland: "Ashok Leyland is the second largest medium and heavy commercial vehicle (MHCV) manufacturer in the country, commanding a market share of about 28%. The MHCV segment is in an upcycle, given the uptick in economic growth which should result in better freight movement," said brokerage.
              The firm believes Ashok Leyland's margins are likely to improve 360 bps year-on-year over FY2015-17 period on account of double-digit growth in MHCVs and reduced discounting. It assigned EV/EBIDTA multiple of 13 times to FY2017E EBIDTA to arrive at a target price of Rs 111 per share.
              2) HCL Tech: Angel Broking expects HCL Tech to post a dollar and rupee revenue CAGR of 13.0% and 13.2%, respectively, over FY2015-17E. The Management expects EBIT margins to sustain at 21-22%, driven by moving work offshore and efficiency-led gains.
              "We expect the EBIT and PAT to post a 12.9% and 10.6% CAGR, respectively, over FY2015-17E. At current valuations, the stock is attractively valued and hence we maintain our 'buy' with a price target of Rs 1,132," said brokerage.









              3) Larsen & Toubro:
              L&T is sitting on an order book of Rs 2,44,097 crore, as of September quarter of fiscal year 2015-16, which gives revenue visibility for over the next 30 months. Considering the huge order book, the brokerage expects L&T to report a 12.5 per cent year on year top-line growth for FY2016E.
              "We are of the view that L&T is a proxy play for investors wanting to ride on the revival of the Indian infrastructure growth story. We recommend a 'buy' on the stock with a target price of Rs 1,646," said brokerage.
              4) Amara Raja Batteries: Angel Broking believes Amara Raja is a well diversified auto ancillary player having presence across the automotive and the industrial segment and a broad OEM as well as replacement customer base.
              "We believe Amara Raja is a high quality stock to play the auto sector revival. We assign a P/E multiple of 28x to FY2017E earnings and arrive at a target price of Rs 1,040 per share," said broking firm.
              5) Axis Bank: "Healthy pace of branch expansion and a strong distribution network continue to be the driving force for the Axis bank 's retail business," said the brokerage.
              "While the near term asset quality environment remains challenging, the bank will be able to absorb the credit costs given the adequate profitability. Further, given its strong CASA and retail network, the bank is positioned strongly to benefit once the macros revive," added the broking firm," added the brokerage.
              Angel Broking recommended a 'buy' rating on the stock with a target price of Rs 630.
